Representative Experience
  • Obtained summary judgment for local transportation client in a disability discrimination case pending in the U.S. District Court for the Eastern District of Texas.
  • Successfully represented a Texas church that was sued for an audit of books and records under the Texas Non-Profit Corporation Act. The court found the suit was a pretense to litigate purely ecclesiastical matters and ruled that it lacked subject matter jurisdiction under the First Amendment of the United States Constitution as a result. The suit was dismissed summarily and my client awarded attorney’s fees and costs.
  • Obtained summary judgment for local accounting firm in multimillion dollar auditing malpractice case whereby plaintiff’s claimed the accounting firm engaged in fraud and conspiracy with audit customers.
  • Obtained summary judgment for local accounting firm in multimillion dollar auditing malpractice case whereby plaintiff’s claimed the accounting firm engaged in fraud and conspiracy with audit customers.
  • Obtained Special Appearance and Dismissal with Prejudice for New York law firm in legal professional liability action.
  • Obtained summary judgment in the United States District Court for the Northern District of Texas in medical device defect case based on preemption argument (prior to United States Supreme Court case clarifying the law in this area).
  • Successfully defended and prosecuted non-compete/trade secret actions for professionals and businesses, seeking to enjoin or block injunction based on claims of breach of contract, usurping corporate opportunities, trade secrets and other proprietary business information. Experience includes obtaining and defending against Temporary Restraining Orders and lengthy evidentiary Preliminary Injunction hearings.
  • Successfully defended national lending institution in several arbitration, state court and bankruptcy cases involving lending law issues. In addition, briefed an important lending law issue to the Texas Supreme Court on behalf of national mortgage lending company.
  • Obtained a favorable, creative and confidential business settlement of a highly contentious corporate malfeasance claim on behalf of one of the largest non-profit religious organizations in Plano, Texas.
  • Favorably resolved half a billion dollar products liability suit arising from a pipeline rupture after assembling an extraordinary “dream team” of defense experts and filing a dispositive motion that likely would have disposed of some or all of plaintiff’s claims as a matter of law.
  • Obtained dismissal of a class action breach of contract suit filed in federal district court against an international sports-related travel agency. The suit concerned delivery of opening ceremony tickets for the 2008 Beijing Olympics.
  • Obtained summary judgment for a publicly traded motor carrier company in an age discrimination suit pending in Dallas County District Court.
  • Won bench trial of breach of contract claim and defeated similar counterclaim for long-time and well-regarded public relations consultant. The court awarded actual damages and attorneys’ fees. When the judgment debtor failed to pay the judgment, we were successful in a turnover action, again obtaining an award of fees for our client.
  • Obtained dismissal of multiple administrative charges of discrimination, including those before the Colorado Department of Regulatory Agencies, Civil Rights Division; Illinois Department of Labor; Texas Workforce Commission; and the United States Equal Employment Opportunity Commission.
  • Obtained dismissal of an administrative proceeding before the State Board of Public Accountancy for accounting firm in a very contentious malpractice and breach of fiduciary duty case.
