Hermes Sargent Bates has extensive experience in the defense of suits involving claims of predatory lending, such as failure to disclose or otherwise conduct transparent lending under the federal Truth in Lending Act (TILA) and the Real Estate Settlement Procedures Act (RESPA), as well as similar claims under state disclosure statutes.

Our lending lawyer team takes an aggressive approach to defending lending institutions. When appropriate, the firm engages experts early in the litigation to review the alleged misconduct and to guide discovery with an eye toward judgment as a matter of law. Our firm generally is the first to seek and obtain discovery. In this way, we control the pace of the litigation and obtain the information necessary to support dispositive motions and early settlement. In all cases, we develop and consider creative business solutions in an effort to avoid the expense, risk and delay attendant with protracted litigation.

Our team includes former experienced bankers who understand the problems unique to the banking and finance industries.
